Order passed on separate sheet and announced in open court, On account of non-attendance of complainant and remaining PWs, accused cannot be subjected to agony of dates, particularly when complainant and PWs are not willing to proceed with the case. Hence, keeping forth the above position, I hereby order that this Sessions case be kept in abeyance against accused Badar s/o Moula Bux, Muhbat s/o Ahmed Ali, Din Muhammad @ Imamuddin s/o Muhammad Bux and Sudheer Ahmed s/o Muhammad Bux, all by caste Khaskheli are present on bail, surety already submitted by them shall be bound for the period of three years. Prosecution side is at liberty to apply for re-opening of the case after availability of complainant and remaining private witnesses. While passing this order reliance was respectfully placed on reported case of SIP Saeed Ahmed Shaikh and others v/s Muhammad Bakhsh and another (SBLR 2015 Sindh 948). P.R bond obtained from them which is kept on record. Put off to:-17-09-2025, for compliance.
