Criminal Misc: application U/S 491-A Cr.P.C called. Applicant alongwith Mr. Zaheeruddin Nohri learned advocate for applicant is present. Mr. Hemoon Kolhi learned ADPP for state is present. Notice returned duly served upon opponent. Opponent No.1 is present. Today the alleged detenue Mst. Najma has been produced before this court by SIP Amir Bux Nohri of P.S Kaloi with the help of LPC Gulzari buckle No.942. Statement of alleged detenue namely Mst. Najma is recorded. In view of the statement of Mst. Najma, the alleged detenue, wherein she has wished to go/accompany with Muhammad Umer (applicant) who is her father. Since she is sui juris, as such, she is allowed to go wherever she desires. The SIP and LPC above named are directed to leave the applicant along with his daughter (alleged detenue) Mst. Najma up-to their destination safely. Accordingly, the instant application stands disposed of. Opponent Mushtaque Ahmed, is, however, left at liberty to avail the legal remedy as provided under the law, if he desires so.
