Case called. ADPP is present. R & Ps received from the Court of learned Consumer Protection Civil Judge, Matiari. Perusal of the R&Ps sent up by the learned Consumer Protection Civil Judge, Matiari shows after taking cognizance of offence punishable Section 397 PPC, he sent up the R&Ps of the case for the reason that same is exclusively triable by the Court of Sessions. However, on perusal of police papers it appears that during the commission of offence neither accused used their weapon, nor any person sustained injury which is one of the ingredients to invoke offence punishable under section 397 PPC. Thus the case is triable by the Court of Judicial Magistrate for the offence punishable under section 392 PPC.
The R & Ps of the case hereby transferred to Consumer Protection Civil Judge, Matiari to proceed with the trial of the case in accordance with the law. Put of to.21.05.2026. Office is directed to sent the R & Ps accordinly.
