Received Sessions Case from the court of Honorable Sessions Judge Ghotki for disposal according to law which is fixed for hearing today. Accused (1) Hakim Ali son of Moula Bux Memon is present on bail as per challan sheet and case diary. Accused (2) Nawab son of Ghulam Qadir Pitafi has been linked and produced by the jail authority of District Prison Ghotki through video link. Accused (3) Altaf alias Chakoo son of Nizam Deen Pitafi has also been linked and produced by the jail authority of Central Prison Sukkur. While accused (4) Ghalib son of Meeral alias Ghazi Khan Sundrani jumped the bail and absconded away. The learned ADPP for the State and DC are present. Charge against accused framed (Exh 02). Pleas of accused recorded (Exh 2/A to Exh.2/C). PW-01 complainant & I.O Muhammad Sukhiyal PW-2 PC-4546 Ali Murad Laghari, PW-03 HC Talib Hussain Shaikh and PW-04 I.O ASI Muhammad Sachal Thaheem are present and examined (Exh 03 to Exh 06). The learned ADPP for the State filed statement for closing the side of prosecution evidence, which is taken on record (Exh 7). The statements under section 342 Cr.P.C of accused recorded (Exh 8, Exh:9 and Exh.10). Final arguments heard. Judgment passed on separate sheet (Exh 11) and announced. Accused (1) Hakim Ali son of Moula Bux Memon is present on bail, his bail bonds are cancelled and surety discharged. While accused (2) Nawab son of Ghulam Qadir Pitafi and (3) Altaf alias Chakoo son of Nizam Deen Pitafi have been produced through video link. Let their acquittal slip in this case be sent through proper channeal.Accused Ghalib is also acquitted in absentia. The case of accused Ghalib is hereby bifurcated from the case of present accused. However, surety proceedings against his surety will be continued. Issue notice u/s 514 Cr.P.C to his surety of accused Ghalib for 10.11.2026. |
