Learned counsel for the accused, Mr. Muhammad Aamir Malik, Advocate, is present. However, the custody of the accused has not been produced through video link by the jail authorities, despite directions previously issued by this Court. It has further been brought to the notice of this Court by the Reader that a newly engaged counsel, namely Mr. Rana Muhammad Arshad, has filed his power of attorney, thereby superseding the authority of the counsel presently in attendance. Learned counsel Mr. Muhammad Aamir Malik has objected to this development on the ground that his professional fee remains unpaid, and he has been informed by his client/accused that no new counsel has been engaged to replace him. He has emphasized that he intends to consult the newly engaged counsel to ascertain how and when such authority was obtained, as the entire proceedings thus far have been conducted by him on behalf of the accused. The record reflects that the fresh power of attorney, filed on 19.08.2025, has been duly endorsed by the Jail Superintendent and forwarded to this Court. On the other hand, it is evident that only one witness the Investigating Officer remains to be examined. Despite repeated warrants and opportunities granted over the last eight months, the prosecution has failed to produce this witness, which amounts to a blatant violation of this Courts orders. Accordingly, let a final show cause notice be issued to the concerned SIO. A report shall also be forwarded by the office of this Court to the competent SSP regarding the delinquency of the IO. The SSP concerned is further directed to submit his report without prejudice, delay, or failure, on the next date of hearing, i.e., 13th October 2025.
