Complainant is present and submitted application in which she stated that she do not want to record the evidence of PW Mst Darya. Order on it. Which is taken on record at Exh. 33. Learned counsel for accused filed application u/s 540 Cr.P.C for issuing the summons to witness Mst Darya Bullo. Order on it. Notice to prosecution. SIP Sadique Ali called absent. Order passed on order sheet. In compliance of directions, SSP Khairpur submitted report which shows that SIP Sadique Ali was directed to appear before this court on 09.01.2026 nor today he is present. SHO PS B.Section Ghotki submitted report that he has served the summon upon witness SIP Sadiqaue Ali even he called him and also maintained entry at station diary of PS Piryalo where said witness SIP Sadique Ali is presently posted but neither he appeared nor submitted any intimation which shows that either he is negligent in his duty or he has no respect for lawful orders of the court. Let a complaint be registered against him, in this regard office is directed to register the complaint against SIP Sadique Ali under section 174 & 175 PPC. Issue NBWs for witness SIP Sadique Ali through DIG Sukkur, he shall execute the warrant personally or through any police officer not below the rank of ASP and produce witness on next date of hearing. Let the salary of said witness SIP Sadique Ali be stopped and keep him under suspension till he appeared before the court for evidence. Case put off to 29.01.2026, for evidence.
