R & Ps received from the Court of learned Civil Judge & J.M-II Hala. Case called. Accused Huzoor Bux, Mehmood, Khadim Hussain, Sadam Hussain, Ajab Gul Senghar, Hussain Ali Akbr, Wali Muhammad, Arshad Ali, Arif Mustafa, Mumtaz Ali, Muhammad Khan, Bilawal, Abdul Rasheed and Muhammad Umar are present on bail, accused Rab Dino called absent with intimation. Accused Nabi Bux, Channesar and Nawab are already declared as proclaimed offenders and accused Rasool Bux is expired proceeding against him is already abated. Learned ADPP is present. Order passed and pronounced in open Court. Perusal of the R & Ps sent up by the learned Civil Judge & J.M-II Hala shows after taking cognizance of offence punishable Section 324 PPC, he sent up the R & Ps of the case for the reason that same is exclusively triable by the Court of Sessions. Perusal of the police papers shows that in final medical certificates the injuries of injured Wasayo, Muhammad Ismail, Shahnawaz, Pahalwan, Anil and Ahmed Khan is determined to be Shajjah-i-Maudiah, Shajjah-i-Khafifah, other kind of hurts, Jurh-Ghair Jaifah Hashimah, injury No.02 and 03 are declared as other kind of hunrts, Ghair Jaifah Damiyah and the injuries are as shown in the medicolegal certificates are punishable under section 337-A(i),A(ii), F(i), F(v),L(ii), PPC, which are triable by the Court of Judicial Magistrate. The record further shows that ingredients of Section 324 PPC are not attracted to this case. The R & Ps of the above mentioned case is hereby transferred to Civil Judge & J.M-II Hala to proceed with the trial of the case in accordance with the law. Put of to.10.03.2026. Present accused are directed to attend transferee Court on next date of hearing.
