Case called. Accused is present on bail. Learned ADPP for the State present. Today, the accused filed a joint application for pleading guilty at Ex.03. A show cause notice under Section 243 Cr.P.C. was issued at Ex.04, to which he submitted a reply at Ex.04/A stating that he is remorseful for the offence, will not repeat it, and is the sole breadwinner of his family. He prayed for leniency. The learned ADPP raised no objection. Heard. Record perused, perusal of record which reveals that the accused is convicted under Section 243 Cr.P.C. Considering that he has saved the Court???s time, is a first offender, and keeping in view his age, status, nature of the offence, and his submissions, a lenient view is taken. He is sentenced till the rising of the Court and to pay a fine of Rs. 3000/-. In default of payment of fine, he shall undergo simple imprisonment for one month. Benefit of Section 382-B Cr.P.C. is extended to him. As the accused is present on bail, his bail bond stands cancelled and the surety is discharged from liabilities. |
