Order passed and announced in open court, the evidence available on file recorded earlier, I am of the considered view that further proceedings of the case will be futile exercise as the complainant in his thrice and injured as well as witnesses in their twice recorded evidence have not implicated any of the accused deposing that alleged offence was committed by 19/20 muffled faces accused, therefore, there is no probability or possibility of the accused being convicted in the case in hand. Consequently, I acquit the accused (1) Fazal S/o Mitho Chandio (2) Manthar S/o Fazal Chandio and (3) Ghulam Nabi S/o Mitho Chandio U/S.265-K Cr.P.C from the Charge. Accused Ghulam Nabi is present on bail, his bail bond stands cancelled and surety stands discharge.
