PW Fayaz Hussain was brought into the witness box for his examination-in-chief, on which Mr. Zulfiquar Ali Panhwar, Advocate for accused Ali Sher, Abdul Shakoor, Abdul Samad and Haji Aarab objected that he would not proceed with the case until and unless I.O is in attendance. Rest counsel also did not agree to proceed with the case. The case is under direction vide order dated 26.05.2025 in Criminal Transfer Application No. S-03 of 2025 of Hon???ble High Court of Sindh Bench at Sukkur to be disposed of within three months of the order and no unnecessary adjournment be granted to either party even every efforts be made to avoid delay in the conclusion of trial. On last date of hearing, a show cause notice was issued to accused Ghulam Hussain, whose counsel remained absent for about six hearing as to why bail should not be cancelled. Reply of show cause notice has been given that has been brought on record. Rest accused were directed to proceed with the matter but none of them was ready to proceed with the matter as such the Court warned them that their bail might be cancelled because of misuse on their part but even than they did not agree, as a result thereof, the accused were taken into custody and order was started to be written for cancellation of their bail, in the meanwhile learned counsel for the accused requested and submitted undertaking that they would proceed with the case positively and in case they failed to do so, the Court may be take any sort of action and sought pardon. In the interest of justice, the prayer of learned counsel for the accused as well as the accused, they are ordered to be released from the Custody with directions to proceed with the case positively on next date of hearing keeping in view the order of Hon???ble High Court of Sindh Bench at Sukkur referred above.
