R & Ps of instant Crl.Misc.application u/s 491-B Cr.P.C received by this Court from Honourable Sessions Judge/Justice of peace, Kashmore @ Kandhkot by way of transfer for its disposal according to law. Statement of detainee Sawera Chachar recorded by this Court wherein she stated that she is residing with her husband out of her own free will and volition, shee absolutely safe and secure with him. Under the circumstances, she do not want to go with her mother/applicant Mst.Zahooran Chachar, and she explicitly desire to go and reside with her husband, Lal Bux. Arguments heard from both the sides. Order also passed, signed and announced in open Court. For the reasons to be recorded, the detainee, Mst.Sawera, is set at liberty being suit juris, to join her husband namely Lal Bux (respondent No.3) being his wedded wife, subject to his (respondent No.3???s) furnishing a personal bond in the sum of Rs.500,000/- (five lac), ensuring safety and well-being of her wife Mst.Sawera. The petition, having served its purpose, stands disposed of in the above terms. The required personal bond in the sum of Rs.500,000/- (five lac) furnished by the respondent No.3 and custody of detainee Mst.Sawera handed over to him, accordingly. |
