By this Order, I am intending to dispose of Notice U/s: 514 Cr.P.C issued to the surety of accused Allah Wassayo namely Mai Mukhtiar in S.C No.435 of 2025. Brief facts are that, one ASI Muhammad Sukhial registered FIR in hand against present accused and others qua his and his companions??? obstruction in lawful duties and police party which resulted in encounter. The accused was arrested along with crime weapon. After making codal formalities, trial has been commenced; during that, accused Jan Muhammad jumped away, consequently, committal proceedings were issued against him besides forfeiture of his surety bond followed by the notice to his surety. Despite receipt of the notice & time sought by the surety who didn???t prefer to reply. Case in hand has repeatedly been fixed for submission of reply by the surety Mai Mukhtiar but didn???t avail by her. On the other hand, accused who were under obligation to attend this Court regularly failed to do so and on his appearance/production was remanded to District Prison Ghotki. Finally the trial of accused has been concluded and he has been acquitted. Since the case has been disposed of and accused was produced by surety; therefore, this Court taking lenient view do hereby impose an amount of Rs.10,000/- as fine against the surety Mai Mukhtiar. She is directed to deposit the amount with Nazir of this Court under token of receipt. After the deposit, the surety in hand be ordered to be redeemed. |
