Case called. Learned ADPP for the state is present. Accused M.Adnan is present on bail along with his counsel, while accused M.Arshad is produced in custody by the Jail Authorities. Learned ADPP for the state and DC of pauper accused M.Rashid are present. In compliance with Section 241-A Cr.P.C, copies of relevant prosecution documents were supplied to the accused, duly acknowledged vide receipt marked as Exh.01. The accused submitted an application for waiver of the mandatory waiting period, which was taken on record as Exh.02. Thereafter, charge was framed against accused, recorded as Exh.03. Upon formal framing of charge, the pleas of the accused was recorded at Exh.3/A & 3/B. Both the accused pleaded guilty and requested for mercy from the Court. Additionally, the accused separately submitted application pleading guilty, which is placed on record as Exh.04 & 05. Subsequently, show cause notices regarding sentencing were issued to accused, marked as Exh.06, to which they submitted his reply, placed on record as Exh.07. After hearing the parties and considering the plea of guilt and replies submitted, the matter was taken up for order. Resultantly, accused, are hereby convicted under Section 243 Cr.P.C on the basis of their voluntary plea of guilt. They both are sentenced to undergo imprisonment for the period already undergone in judicial custody, with the benefit of Section 382-B Cr.P.C extended to them and fine amount of Rs.6,000/- is also imposed upon the accused M.Adnan, who is on bail, in default he shall be taken into custody for one month more. The fine amount has been deposited before Nazir of this Court and produce its receipt. The accused M.Rashid is remanded back to jail, and conviction warrants be issued accordingly for execution of sentence, as per law. Order pronounced in open Court. In compliance of section 371 Cr.PC a copy of order is also supplied to both accused on free of cost under the receipt at Exh.08, accordingly. |
