Succession Application called. Applicant and his counsel are present and submitted statement alongwith publication in daily Awami Awaaz dated 05.07.2026 at Ex:09. Order passed on it. Opponents No.03 to 09 are present and they have filed affidavits, wherein they have given no objections to grant succession application at (Ex.10 to 15) Order passed on it. Two persons namely Muhammad Nawaz and Muhammad Shoaib are present and they have also filed their affidavits in support of the contentions of applicant (Ex: 16 and Ex: 17). Order passed on it. Arguments heard. Order passed on application U/S 32 Rule 3 CPC, the instant application has been allowed. Order passed and announced in open Court. Succession Application is allowed subject to execute of PR Bond in the total amount. However, in order to avoid any complication and to safeguard the interest of parties, Accountant of Honourable District Court Sanghar is appointed as Commissioner to collect amount from concerned bank as mentioned in para No.5 (supra), and disburse the same amongst applicant and opponent Nos. 2 to 6 as per their shares according to Muhammaden Law under proper receipt. So far share of opponent Nos. 7 to 9 is concerned, as they are minors, as such, in order to safeguard their interest, Accountant of Honourable District Court Sanghar is further directed to invest the share of minor opponent Nos. 7 to 9 in profitable scheme of National Savings Center, Sanghar till they attain the age of majority or as per order the competent court of law. Advocate for applicant is directed to produce the share list of legal heirs within one week. Application stands disposed of in above terms. |
