Matter called. Plaintiff No.01 namely Allah Jurio who is attorney of remaining plaintiffs No.02 to 08 and their counsel Mr. Ali Hassan Solangi are present and submitted application for time to submit Court Fees Stamp Worth Rs: 15,000/- at Ex.11. Order passed on it. Allowed and time is granted till next date of hearing; detailed order passed on separate sheet; the record reflects that the since institution of the present suit the plaintiffs have not been paid requisite court fees on the plaint. Number of times the plaintiffs have sought time/permission to submit the same but failed till today. It is a settled procedural principle that a party should ordinarily be afforded a reasonable opportunity to make good the deficiency in court fee, subject to the discretion of the Court and the circumstances of the case. However, such indulgence cannot be permitted to operate indefinitely or to cause unnecessary delay in the proceedings. The plaintiffs are, therefore, required to comply with the direction of this Court within the time specifically granted herein. Accordingly, the plaintiffs are conditionally permitted to make good the deficient court fee. The plaintiffs shall deposit/pay the entire deficient court fee on or before the next date of hearing. In case the plaintiffs fail to deposit the deficient court fee on or before the next date of hearing, the suit shall liable to be dismissed for non-compliance/default as provided u/o 7 Rule 11 (c) CPC. Defendants No.02 to 07 & 09 10 called absent. Defendant No.08 present.
