Case called. Accused Muhammad Juman and Habibullah are present on bail,while accused Muhrram is already declared proclaimed offender. Judgment passed and announced in open court. Both accused are convicted U/S 245(ii) Cr.PC and sentenced to one year SI and fine of Rs. 10000/- jointly which is to be paid within a week. In default of fine accused shall be liable to suffer three months simple imprisonment. The benefit of section 382-B Cr.PC is also extended to acucsed. since both acucsed persons are first offender and theyare not privously convicted and they are sole members of their respective families, hence they are released on probation instead of sending them jail to serve out the sentence. Both accused are directred to execute the PR bond of Rs. 50,000/- jointly without surety that they would not commit any offence during the period and shall keep the peace and maintain good behaviour. The probation officer isdirected to submit quarterly reprot to accused persons regarding their codncut for that period. The probation order shall cease to have effect once the acucsed conduct for that peirod. Case against abscodner acucsed Muharram is kept on dornment file, till his arrest. |
