The plaintiff during his examination-in-chief produced original cheque dated 05-11-2019 bearing No.46492525 amounting to Rs.1500000/- drawn on NBP Kumb branch along with memo of return dated: 25-11-2019 at Exh.P/2 and P/3, respectively. During the cross-examination, Mr. Asadullah Ghumro, learned advocate for defendant requested for seeing the original cheque and bank memo, which were handed over to him in the open court for perusal and cross examination purpose. After the lengthy cross-examination from plaintiff and his witness, the matter was adjourned. When the court demanded the cheque and memo back from Advocate Mr. Asadullah Ghumro, he did not return the original cheque and bank memo and he replied that the same cheque and memo were left by him on the dice of court room. Mr. Asadullah Ghumro took/obtained the cheque and memo from this court in the open court for cross-examination of witnesses and it was his responsibility to return the same after cross examination. Such act cannot be expected from an Advocate. Therefore, Mr. Asadullah Ghumro, advocate for defendant is strictly directed to return the above detailed original cheque and bank memo to this court for keeping the same on record. In case of failure, the matter will be dealt with as per law. For the purpose of record and evidence, let the photocopies of cheque and bank memo attached with the memo of plaint be exhibited with the evidence of plaintiff. Meanwhile, office is directed to call for CCTV recording of court room from 01:00 p.m. to 03:00 p.m., from the CCTV Monitoring Room/CCTV Operator of District Court, Khairpur, for record..
