Sessions Case called. Accused Muhammad Arif is produced in custody, while other accused are absconding and declared as POs. DDPP for the State and Mr. Ajeebullah Junejo advocate for accused, complainant and his advocate are present. SIP Allahdino is called absent and he has already filed his objections on application u/s 193 PPC. Arguments of learned DDPP heard as well as further arguments of Junior to DC and advocate for complainant. Applciation u/s 193 PPC is dismissed, also Judgment passed on separate sheet (Exh 23) and announced in open court. The prosecution has successfully proved its case against the present accused beyond the shadow of doubt. In this case, since the accused has not made any confessional statement, nor Tazkiyatul Shahood has been taken from the witnesses, therefore, the sentence of death as Qisas under clause (A) of Section 302 PPC could not be passed. In this case, the specific role of firing upon the deceased Adam Khan is alleged against the present accused and so also against the absconding co-accused Manik, Mehrab, Reham Dil and Adbullah, and it is not certain that which of the fire made by said accused persons is fatal for causing death of said deceased, therefore, the present accused Mohammad Arif @ Arif S/O KouroBheri is convicted u/s 265-H(2) Cr.P.C, for committing offences, as Tazir and is sentenced i.For committing offence u/s 148 PPC, the accused is sentenced to suffer R.I for three (3) years & to pay fine of Rs.10,000/-, and in default thereof, he shall undergo S.I for one month more ii. For committing offence U/S 302 (b) PPC r/w Section 149 PPC, the accused is sentenced to undergo R.I for life & to pay fine/compensation of Rs.1, 00,000/- (one lac) payable to the legal heirs of the deceased Adam Khan, and in case of default thereof, the accused shall undergo S.I for six months more. The convictions & sentences for the offences U/Ss: 148 /149 and 302/149 PPC shall run concurrently and the benefit of Section 382-B Cr.P.C is also extended to the accused. The accused is produced in custody from Central Prison Sukkur and is remanded to the C.P Sukkur alongwith the conviction warrant and conviction slip to carry-out the conviction and sentences awarded to him as mentioned above. The copy of Judgment be given to learned DDPP for the State as required u/s 373 Cr.P.C and also to the accused, free of costs. The case against absconding accused persons, namely, Ali Nawaz, Manik, Mehrab, RahamDil and Adbullah is ordered to be kept on dormant file till their arrest or appearance before the Court. The proceedings against absconding/proclaimed offenders be continued in the light of case reported as Nasrullah v. Station House Officer, Police Station Jacobabad and 6 others (PLD 2016 Sindh 238), wherein a complete mechanism and guideline has been provided for acting further in such situations. The copy of Judgment supplied to accused on free of costs, such receipt obtained from him and kept on record (Exh 24). Copy of conviction warrant and conviction slip kept on record (Exh 25 & Exh 26). R&Ps be consigned in the record room after its due completion and compilation. |
