Matter called. Learned counsel for the plaintiff is present. Learned counsel for the defendant No.1 and filed written statement & C.A to the application U/O 39 Rule 1 2 CPC which is taken on record and copy to other side. None is present from rest of defendants side. Issue summons to defendant No.2 with direction to appear in person alongwith approved layout plan in respect of the Society on the next date of hearing. Learned counsel for the defendant No.1 contended that the plaintiff is claiming his Plot bearing No.R-45 however the defendant No.1 is in possession of the Plot No.R-23. Heard and perused the case file. Order passed on separate sheet. The Nazir of this Court is appointed as Commissioner to conduct the inspection in respect of suit property with the help of approved layout plan which he shall obtained from the Society and also in presence of both parties and also presence of officials of Society. The defendant No.2 is directed to supply approved layout plan of society wherein clear plot numbers are mentioned to the Nazir of this court at the time of inspection and also assist the Nazir in order to ascertain the original plot number which is in physical possession of the defendant No.1. Nazir fee is fixed at the rate of Rs.10,000/- shall be borne half by the plaintiff and half by the defendant No.1. Put off to 11.10.2025 filing W.S & C.A by defendants no.2 to 4 and also compliance report. |
