Execution application called. Decree Holder and his counsel are present. J.D is produced by jail authorities who apprised that the subject property is also put into auction by this court vide order dated 23.09.2025, which has been illegally occupied by certain culprits, and he has filed earlier petition under the provisions of the Illegal Dispossession Act. It is a matter of record that despite of publication, none has participated the auction. It is obvious that the property, which is under occupation of some persons other than J.D, as much as where against the petition under the provisions of the Illegal Dispossession Act is pending, how any genuine buyer opt to buy such property. In the circumstances decree holder may furnish the particulars of other property of J.D for proceeding and recovery of the decreetal amount. Meanwhile J.D may deposit the decretal amount for seeking release from civil prison. The learned counsel for the applicant is directed to satisfy the court as to how the accused can be put in the civil prison when his property has been attached and put into auction.
