Today, the matter is fixed for the evidence of the plaintiff in the leading suit. However instead of producing witnesses and leading evidence, the learned counsel for the plaintiff in leading suit has moved an appln: U/O 1 Rule 10 CPC for impleading one Urus Shahani by as the proposed defendant No. 09 in leading suit. Such application was taken on record at Ex------104, and the same was dismissed in limine for the reasons stated in order sheet Ex-----105. Learned counsel for the plaintiff in the leading suit, through his associate, again instead of proceeding with the matter has filed another appln: for adjournment Ex---106, It is pertinent to mention that this Court vide order dated: 02-04-2026 passed on the last date of hearing issued clear direction to the parties involved in view of the direction issued by the Honourable High Court of Sindh, Circuit Court Hyderabad, in C.P No. S-505 of 2025 for expeditious decision of the matter preferably within two months. The relevant paragraphs of that order are reproduced as under: ???In view of the above directions issued by the Honourable High Court of Sindh, Circuit Court, Hyderabad, duly communicated by the previous learned Trial Court (learned Senior Civil Judge, Matiari), a time-frame of two months for disposal of the leading suit has been fixed, which is now consolidated with subsequent suit, thus, this Court under obligation to proceed with these suits expeditiously as per command /directives of the Honourable High Court, it is therefore, the parties to these suits and their respective learned counsels are taken on board through this order to ensure that they should lead their respective evidence by producing desired witnesses on the date fixed for their respective evidence without any excuses. The parties and their respective learned counsels are instructed further that no adjournment(s) shall be granted to either party except in case of grave emergency or unavoidable circumstances, so that the matter could be concluded within the time stipulated by the Hon: High Court of Sindh, Circuit Court, Hyderabad.??? the consolidated issues framed/settled by this Court today on separate sheet Ex----101, however, in the meanwhile the parties are at liberty to file their respective list of witnesses and list of documents, if not submitted earlier, with advance copy to the others.??? This Court, in previous occasion, vide order dated.02.04.2026 (Ex.102) made it explicitly clear and specifically placed all parties and their counsel on board warning that no adjournments would be granted except in grave emergencies, although on previous date of hearing viz., 09.04.2026, an application for adjournment (Exh.103) filed by the associate to learned counsel for the plaintiff in leading suit, was allowed in the interest of justice, yet the application at hands. Apparently, the conduct of the plaintiff in leading suit, first filing a repetitive application and then seeking an adjournment appears to be an attempt to linger on the time-bound mandate of the Hon: High Court of Sindh, Circuit Court Hyderabad, referred above, for which this Court cannot remain a silent spectator to such dilatory tactics. However, in the interest of justice and to provide a final opportunity to the party to produce their evidence, the adjournment application at hand is hereby allowed, subject to a cost of Rs. 2,000/- to be deposited in the Government Treasury forthwith with Nazir of this Court.
