Applicant is present along with his counsel Opponent namely Noor ul Ain is present and her counsel is also in attendance Considering the tender age of the minor, his emotional, physical and psychological needs, and applying the settled principles governing interim custody under Section 12 of the Guardians and Wards Act, 1890, this Court is of the considered opinion that the balance of convenience, prima facie case and the welfare of the minor presently lie in favour of Respondent No.1/mother. Hence, the application under Section 12 of the Guardians and Wards Act, 1890 is allowed. The interim custody of minor Muhammad Arham Khan is hereby entrusted to Respondent No.1/Mst. Noor-ul-Ain during the pendency of the main Guardian & Wards application.The applicant/father is directed to hand over the custody of the minor to respondent No.1 forthwith, if not already delivered. The applicant/father shall, however, be entitled to reasonable visitation rights. He may meet the minor on every Sunday from 10:00 a.m. to 12:00 p.m. at a place mutually agreed upon by the parties or at such place as may be fixed by this Court, without causing any inconvenience to the minor. Needless to observe that these observations are tentative in nature, made solely for deciding the present application, and shall not prejudice the merits of the main Guardian & Wards application, which shall be decided independently after recording evidence. This order is based on tentative assessment hence shall not affect the merits of the cas Matter adjourned to 04.08.2026. for issues |
