In the foregoing reasons and in view of the earlier evidence, when two of the co-accused namely Nazeer Chandio and Nisar Chandio were acquitted U/S. 265-H(i) Cr.P.C by this Court after recording evidence of material witnesses and later on two other co-accused namely Sajjan Chandio & Kheral Chandio were acquitted U/S.265-K Cr.P.C, therefore, if the charge is framed against the present accused and evidence of same prosecution witnesses is recorded, the result naturally would come in terms of acquittal of accused, therefore, in view of the above I have left no option except to acquit the accused, consequently I acquit the accused Ayaz S/o Kheral Chandio U/S.265-K Cr.P.C from the charge.
