Instant order shall govern disposal of sessions case in hand, being received to this Court by way of transfer, from the Court of Honourable District & Sessions Judge, Ghotki, for disposal according to law. 02. Instant case has taken birth in shape of FIR No.45/2025 of P.S Jarwar, lodged by SIP Fateh Ali Mashori, alleging therein that, on 13.09.2025, at 2230 hours, accused Majjan @ Majeed, Hajan, both equipped with K.Ks, Baksh Ali, Majeed, both armed with pistols, and two unknown accused, having lathis, have intercepted police force headed by him accompanied with PC Asif Ali, PC Dabeer Ahmed, PC Ameer Bux, and driver PC Abdul Rasheed, at Link Road near Kander Shakh Bridge, leading from Jarwar to Yaro Lund, and the encounter took place, which lasted for 15 minutes. Official complainant stated that, all accused managed their escape good. It was investigated & SIP Amanullah Kalwar submitted charge sheet against all accused, specifying their names as absconders. Codal formality has been observed by the learned Magistrate for compelling appearance of absconding accused but their whereabouts could not be traced as per statement of process server HC Biland Khan recorded on 23.10.2025 and 04.11.2025. Nothing is registered with their name as immoveable property, as per report submitted by Mukhtiarkar Mirpur Mathelo. All of the accused have been declared proclaimed offenders. Consequently, this Court, drop their case from regular file and keep it in abeyance till their appearance/arrest. However, following the directives of Honourable High Court of Sindh in reported matter, Re-Nasrullah Versus The State, 2016 MLD 236, it is ordered to be fixed on quarterly basis. Office is directed to re-issue NBWs against accused through SHO P.S Jarwar. Let the case be fixed on 25.02.2026. |
