Civil appeal is called, appellant No.5/attorney Nasarullah and his counsel are present. I/C DA is present on behalf of official respondents No.11 to 16. Mr. Deedar Ali Bangwar advocate for respondents No.8 & 10 is also present. Respondent No.15 is present in person. Notice against remaining respondents returned as per endorsement of court bailiff that respondents No.1 & 5 refused to accept the summons while respondents No.3 & 4 shifted away to Hyderabad and no respondents No.2,6 & 7 of such names are residing at the given address and respondent No.9 is confined in District Prison Shikarpur. The incharge DA disclosed that respondents No.1 and 3 to 5 deliberately not appeared before this Court. The service upon respondents No.1 & 3 to 5 is hereby held good. The advocate for appellants filed an application u/s 151 CPC along with supported affidavit of attorney Nasarullah. Order. Notice to otherside, notice waived by otherside with no objection. Heard. Order passed and announced in open Court that the instant application is allowed as prayed. The learned counsel for the applicants is directed to file the amended title sheet accordingly by today. The amended title sheet submitted by the learned counsel for appellants. The incharge DA submitted adjournment application. Order. Adjournment is allowed. Civil appeal put off to:18.12.2025, present appellant is directed to attend. Repeat notices against respondents No.1 and 3 to 5 on costs of appellants through court bailiff with directions to paste the notices on the outdoor of respondents. Issue notices against respondents No.2,6 & 7 through court bailiff on costs of appellant as per fresh names mentioned in the amended title sheet. Notice against respondent No.9 be issued through concerned jail authority for service on costs of appellant. |
