Since, there would be no legal justification to keep the case against absconding namely Abbas, Latif, Mehboob, Zameer, Sikandar and Ghaffar, on dormant file since they are also attributed same role to that to co-accused, therefore, they are also acquitted in absentia by extending them benefits of such doubt, in view of case law reported in case of Mushtaq & others v. The State (SBLR 2010 Sindh-1202). Let, such intimation be sent to the concerned police station for their acquittal accordingly and report compliance. However, case against proclaimed offenders namely Khadim, Azam and Fazul shall remain on dormant file, till their arrest or appearance before the Court. The proceedings against him shall be initiated in view of Nasrullah???s Case reported in PLD 2016 Sindh 238 and for that purpose the same shall be fixed on quarterly basis.
