Today Plaintiff namely Sht: Naveeta w/o Kapil Dive d/o Utam Chand adult Hindu by caste Meghwar, R/o North Colony Diplo Town, Taluka Diplo appeared & filed this Family Suit for Maintenance & Separate residence U/S 2 of the Hindu Married women???s Right to separate residence and maintenance Act 1964 through her counsel Mr. Perma Nand against her husband namely Kapil Dev S/o Jairam, adult Hindu by caste Menghwar R/o Muhalla Parkirya, Ward No:315 Umerkot Town, District Umerkot. The Advocate for plaintiff affixed the required fee stamps of Rs.15/-. The Advocate for plaintiff filed following documents: Memo of Plaint at Exh.01,along with photo state copy of Registration Certificate & Vakalat Nama at Ex:02. Heard Plaintiff and her counsel. Admit. Register, subject to legal objections if any. There is no express repeal clause for the Hindu married women???s Right to separate residence and maintenance act 1946, in hindu marriage act 2017 & 2018 amended section 26 says nothing in this act shall effect any right or remedy under any other law, therefore both acts run parallel. Act of 1946 is special & said act not repeated in Act of 2017. Issue Notice/summons to defendant through Bailiff and Registered Post AD & through Publication on cost of plaintiff.
