UTP Ali Hassan is convicted U/S: 265-H (ii) Cr.P.C for committing rioting, injuring complainant's father Mawali in a murderous assault as well as committing intentional murder (Qatl-i-amd) of complainant???s young un-married sister Razul, aged about 15 years so he stands sentenced for offence punishable U/S 302, 324, 337-F(iii) & 148 PPC R/W section 149 PPC as detailed hereunder; i) He is sentenced for offence punishable U/S 302 (b) R/W section 149-PPC, to death as Tazir for committing Qatl-e-amad (intentional murder) of Mst. Razul D/O Mawali by caste Jaffery. Convict is ordered to be hanged by neck till he is dead, subject to the confirmation of the Honourable High Court of Sindh, Circuit Court Larkana. The convict Ali Hassan is also directed to pay compensation of Rs. 20,00,000/= (Rs. Twenty lac) to the legal heirs of deceased Mst. Razul as provided u/s 544-A Cr.P.C and in case of failure thereto, He will also undergo further S.I for six months and compensation amount will also be recovered from him as per law. ii) He is also sentenced for offence punishable U/S 324 R/W section 149-PPC, for 10 years (R.I) and to pay fine of Rs. 500,000/= (Rs. Five lac) and in case of failure thereto, He will also undergo further SI for two years. iii) He is also sentenced for offence punishable U/S 337-F (iii) R/W Section 149-PPC ???Jurh Ghayr-i-Jaifah mutalahimah??? and directed to pay damn of Rs. 200,000/= (Rs. Two lac) to the legal heirs of injured Mawali S/O Jakum (now deceased) and in case of failure thereto, He will remain inside prison till payment of damn. iv) He is also sentenced for offence punishable U/S 148 R/W Section 149-PPC, for 03 years R.I and to pay fine of Rs. 50,000/= (Rs. Fifty thousand) and in case of failure thereto, He will also undergo S.I for three months. However, co-accused Qasim Jafferi stood acquitted U/s: 265-H (i) Cr.P.C. He is present on bail, hence his bail bond is cancelled and surety discharged. However, case against proclaimed offenders Sain Bux, Yasin and others be kept on dormant file till their arrest or otherwise and life time warrants be also issued as per law. Copy of this judgment supplied to convict today free of cost under proper receipt at Ex. No. 30, in terms of section 371 Cr.P.C with information that he may prefer appeal, if any within seven days of this judgment and a copy thereof communicated to the learned DPP, Shikarpur. Moreover, proceedings of this case be also respectfully submitted before the Honourable High Court of Sindh, Circuit Court Larkana for confirmation in terms of section 374 Cr.P.C. The convict has been produced under custody from District Prison Shikarpur thus he is hereby remanded back having conviction warrant and slip under police custody in order to serve out sentence as per law. |
