The accused Shah Nawaz, situated in village Mang Taggar, Taluka and District Khairpur hence; he is, therefore, guilty for the offence punishable U/S 148, 149 PPC thus, I, hereby convict u/s 265-H(2) Cr.PC and sentence him for the offence punishable U/S 148 and 149 PPC to suffer R.I for two years and to pay compensation of Rs.50,000/- as required U/S 544-A Cr.PC, the compensation if paid be given to the legal heirs of deceased Zahoor Ahmed and in case of non-payment of compensation amount, accused shall suffer S.I for three months more while; taking lenient view in awarding lesser sentence due to mitigating circumstances coupled with the fact that above named accused was not previously convicted in the case nor his previous criminal record is found. Both accused are extended benefit of section 382-B Cr.PC, their period of detention shall be deducted from their sentences. Accused produced under custody, are remanded back to concern jail authority along with conviction warrants to serve out the sentences as awarded to them. The copy of Judgment is supplied to the accused persons free of costs instantly under receipt and they are also informed to file appeal within appeal period, if they wish.
