??Case called. None for the plaintiff. Office report perused. Perusal of record reveals that the present suit has remained pending solely for service upon the defendant. The brief proceedings reflect persistent negligence on the part of the plaintiff, as detailed below: On 18-09-2025, neither the plaintiff nor his counsel appeared and process was returned as per bailiff report; however, this Court, in the interest of justice, directed issuance of notice and summons on cost. On 08-10-2025, 29-10-2025, and 18-11-2025, the clerk of learned counsel for plaintiff appeared, yet process cost was not paid despite clear directions of the Court. Repeated opportunities, including last and final chances, were granted to the plaintiff. On 11-12-2025, bailiff submitted his report; order was passed thereon and service was again directed through bailiff, TCS, registered post A/D and by way of pasting, on cost.??Today, 12-01-2026, office has reported that the process cost was paid only, and despite repeated directions and indulgence by the Court, the plaintiff failed to ensure service upon the defendant. The conduct of the plaintiff clearly reflects lack of interest in prosecuting the matter. This Court has shown sufficient leniency; however, litigation cannot be allowed to linger indefinitely due to inaction of a party. The continued non-compliance attracts the provisions of Order IX of the Code of Civil Procedure, 1908. Accordingly, the suit is dismissed for non-prosecution. Announced in open Court |
