I, therefore, allow this petition with directions to Nazir to call/collect the amount i.e. 1) Pension from 06th July, 2021 Onwards, 2) House Rent Allowance Rs.2578/- per month till the age of superannuation of deceased from 15th December 2020 to 17 December 2039, 3) Lump Sum cash Grant Rs. 9,00,000/- for BPS-9, 4) Cash in lieu of Plot Rs. 50,00,000/- for BPS-9 and 5) Benevolent Fund Grant Case pending from the concerned department and distribute the same among major legal heir namely Mst. Sultana Begum through cross cheque according to her respective share except share amount of minors legal heirs. However, share of minor legal heirs namely Muhammad Ashir Khan and Rutaba Eman be invested in some profitable scheme till they attain the age of majority. The special power of attorney of Petitioner and guardian of the minors namely Muhammad Saleem Khan is allowed to withdraw the profits, after due verification, to serve interest of minors and Nazir is required to maintain such record. Nazir is directed to submit compliance report within 30 days, from the date of the realization of the said amount subject to furnishing PR bond by petitioner in the like amount. In case if any claimant/other legal heir of deceased appears before this Court then the petitioner would be bound to pay his/her share, if found entitled according to law. Order accordingly. However, Rs. 3000/- is fixed as Nazir???s fee. The petitioner is directed to bear the said fee and pay the same to the Nazir, District Courts Karachi East. Announced in open Court. |
