Defendants NO. 1 to 6 are called absent. Defendants NO. 7to 10 and 12 are already made exparte. Heard the learned counsel for both parties and perused the record. It is evident that serious and conflicting claims regarding possession over the suit property have been raised by both sides. Each party alleges interference and unlawful dispossession against the other. The question of actual possession and physical status of the suit property is central to the determination of the pending injunction applications. Under Order XVIII Rule 18 CPC, the Court is empowered at any stage of the proceedings to inspect any property or thing concerning which any question may arise. Furthermore, under Order XXVI Rule 9 CPC, the Court may issue a commission for local investigation where it deems such investigation necessary or proper for the purpose of elucidating any matter in dispute. The object of local investigation is not to collect fresh evidence but to clarify and appreciate the evidence already on record and to obtain spot information for just decision of the case. In the circumstances of the present case, where both parties claim possession and allege alteration of the suit property, it appears just and proper to ascertain the factual status of the suit land before deciding the pending applications under Order XXXIX Rules 1 & 2 CPC. A local inspection would assist this Court in appreciating the rival claims and in maintaining status quo, if required, in accordance with law. Accordingly, Mr. Gulzar Ahmed Brohi, learned Advocate, is hereby appointed as Local Commissioner to conduct inspection of the suit property. The Local Commissioner shall visit the suit land situated at Deh & Tapa Shahdadkot, Taluka Shahdadkot, in presence of both parties and concerned Mukhtiarkar, and shall physically verify and report regarding: 1. The present physical possession of the suit property; 2. The total area occupied or under control of each party; 3. The existing condition and status of the suit land, including any construction, digging or alteration, if any. The Commissioner shall submit a comprehensive report along with photographs, if possible, within the stipulated time before the next date of hearing. The fee of the Local Commissioner is fixed at Rs.10,000/- to be paid by each party. The parties shall extend full cooperation to the Commissioner. Office is directed to issue commission warrant along with copy of plaint, written statement and this order. Pending decision of injunction applications till receipt of Commissioner???s report.
