On the last date of hearing, same complainant appeared before this court and engaged his new counsel namely Mir Kamal Hussain Talpur, advocate, who filed adjournment application for proceeding with the case on behalf of complainant and the complainant appeared before this court and also filed application for suspension and vacation of NBW issued against him. In the interest of justice and to proceed the case, the complainant was given opportunity to record his evidence on next date of hearing (i.e. today). His warrants of arrest were vacated and he was given another opportunity to depose his evidence. As per record, the charge against the accused was framed on 29-08-2025 and thereafter not a single prosecution witness is produced and even the complainant despite appearing in the court sought the adjournments from date to date. Today, the complainant is present in the court and filed statement along with copy of memo of Criminal Transfer Application and he stated that he has now filed a Transfer Application No.S-62/2026 before the Honourable High Court of Sindh Bench at Sukkur on the ground that he has no confidence and hope to get justice from this court. Such statement is taken on record. The counsel for accused submits that this is another tact taken by the complainant to gain more and more dates of hearings and to delay the trial against the accused, including one lady accused, who were in-laws of present complainant having family disputes. In these circumstances, when the complainant is fully reluctant to depose his evidence and raised his grievances in the Transfer Application, therefore this court adjourns the matter. However, the accused, who are impleaded as party in the Transfer Application, may approach the Honourable High Court in the said Criminal Transfer Application. Let the matter be adjourned due to pendency of transfer application of the complainant before the Honourable High Court. Adjourned to 03.10.2026 |
