Suit called. Plaintiff is present in person. Counsel for the defendant No.01 & 02 is present, none has appeared on behalf of the defendant No.03 & 04, while the defendant No.05 has already been struck of vide order dated 17.10.2024. Today matter is fixed for hearing on the application UO VII Rule 11 CPC as well as filing of CA on the application filed by the plaintiff UO 1 Rule 10(2) CPC for addition of the names of successor of defendant No.05 as being necessary party. So also, the application filed by the learned counsel for defendant No.01 & 02 under order 1 Rule 10(1) & (2) CPC read with section 151 CPC for deletion of name of defendant No.01 & 02. As per record, the plaintiff and the counsel for the defendant No.01 & 02 have already done their arguments on the pending applications while none is appearing from the side of remaining defendants No.03 & 04 despite of Court Motion Notices. In the interest of justice, let the notice be issued upon the defendant No.03 & 04 through their counsels for appearance on the next date to make arguments, and given last and final chance to argue on the applications, in case of failure the pending applications shall be decided exparte against them. Put on dated 23.04.2026 for hearing on the applications. |
