Matter called. Today the matter is fixed for service upon Defendants. The summons/notices through M&P/courier service already returned served upon defendant no.1 to 5. Process returned with bailiff report. Order passed thereon, Repeat service upon the defendant No. 1 to 5 through pasting in presence of two witnesses. Advocate for Plaintiff also requested for grant of status quo till appearance of Defendants and filing of written statements/counter affidavits upon application under Order XXXIX rule 1 & 2 CPC available on file and duly supported by Bio-Matric of Affidavit of the Plaintiff. According to counsel for the plaintiff despite service of summons/notices the defendant are avoiding to appear before this Court, rather there is great apprehension that the defendants shall create third party interest in the suit property and thereafter will appear in the proceedings, due to which the Plaintiff shall sustain huge losses and further controversy shall arise.
