Executive Engineer Mirpur Mathelo Division (Irrigation at Mirpur Mathelo) is present along with Canal Assistant. Both officials in attendance submitted that watercourse in question have been sanctioned in year 2003, but now it has been dismantled by the plaintiff himself without lawful authority.Order passed onorder sheet. When confronted, the plaintiff admitted the assertions; added that, same has been developed with his land without lawful authority and he is ready to restore it subject to demarcation of Survey Team. On the other hand, the Executive Engineer Mirpur Mathelo Division, on inquiry qua the action taken against the person being responsible for dismantling the sanctioned watercourse, submitted that, he has recently been posted over here and time is required to him to redress the issue, doing needful if required under the law. Be that as it may, the plaintiff has himself purportedly dismantled the watercourse as admitted by him and his counsel in attendance. The plaintiff is put up on notice to satisfy against maintainability of the suit especially when he has dismantled the sanctioned watercourse before filing the suit in hand. Additionally, the Executive Engineer Mirpur Mathelo Division in attendance is again directed to submit his detailed report along with the measures stepped by him to restore or initiate action qua dismantling the sanctioned watercourse by either person.
