Per file in hand charge in this case was framed on 11.09.2024 and prosecution got examined several PWS including complainant Khalil Rehman Hingoro at (Ex.11) on 14.01.2025, PW Habib-ul Rehman Hingoro (EX-12) on 16.01.2025, and Muhammad Yaqoob Hingoro (Ex.14) on 12.02.2025 but the learned defence counsel Mr. Muhammad Sharif Misrani and Mr. Hussain Bux Chang sought frequent adjournments from time to time which my learned predecessor granted and complainant along with private PWs has been returned un-examined under attending circumstances. Moreover, I resumed my duty in this Court by the end of October, 2025 and directed learned counsel Mr. Muhammad Sharif Misrani to proceed case on several dates as well as appointed Mr. Mir Mal Oad for lady accused Mst Maryam-U-Nisa on state expenses and application sent by her in this regard is also available on record. Today Mr. Ali Khan Laghari advocate appeared and filed his vakalatnama for accused Maryam-U-Nisa in this case as well as in off shoot case, which are taken on record. Mr. Ali Khan Laghari and Mr. Mir Mal Oad extended no objection to the adjournment application, whereas learned ADPP for state and learned counsel for complainant strongly opposed adjournment with submission that case is being delayed by the learned defence counsel Mr. Muhammad Sharif Misrani continuously for more than a year. Complainant along with two private PWs and one official PW are present and all are ready to proceed case, but Mr. Abid Ali Qureshi appeared on behalf of Mr. Muhammad Sharif Misrani defence counsel for accused Naeem Ahmed and Sought adjournment on the ground that his senior is busy in election campaign. Per file in hand this case has already been adjourned several times mostly at the request of Mr. Muhammad Sharif Misrani, who is president of DBA, Sanghar. It is very painful to observe that he has been avoiding to proceed his cases including case in hand obviously for reason that he is sitting president of DBA, Sanghar and whenever this Court started to proceed any case in which he is representing either side he became aggressive and pressurized this Court as well as warned to face consequences by using Bar influence which is against the law and Bar ethics and I, being a sub ordinate judicial officer always tolerated it so that he may not find a lame excuse against me and all old cases pending at file of this Court may be proceeded expeditiously and decided timely on merit as per law. I throughout my service have also observed that office bearers of every bar are stronger than a subordinate judicial officer who is always at their mercy and I have no other option except to sustain insult at their hands. Case in hand is therefore, adjourned as usual as prayed for by his junior counsel as a last and final chance again with the same direction and caution because a fair trial means expeditious proceedings and timely decision on merit as per law and complainant along with his witnesses and official PW are hereby returned un-examined. Moreover, per file in hand Honourabe, High Court of Sindh, Circuit Court, Hyderabad while dismissing Cr.Bail application No.S-793/2024 filed by accused Naeem Ahmed vide order dated: 02.12.2024 directed that the learned trial court will conclude trial within (60)days but under the attending circumstances the case has been delayed and blocked by the learned defence counsel Mr. Muhammad Sharif Misrani, President DBA, Sanghar. To come up on 07.02.2025 as per choice of Mr. Abid Ali Qureshi which according to him is convenient for his senior advocate and other advocates.
