For the reasons to be recorded. Record shows that the father of the deceased Mumtaz Khatoon, namely Munir Ahmed as well as the uncle of above minors namely Ahsanullah son of Amanullah have moved separate applications under section 310 PPC, for compounding the qisas on behalf of above mentioned minors legal heirs of the deceased without filing application under section 345 (4) Cr.P.C by entitling themselves as guardian of the above mentioned minors legal heirs of the deceased, therefore, the merits of these applications under section 310 PPC, needs no consideration and same are hereby dismissed, hence, they cannot compounded this offence on behalf of the minors legal heirs. Although both the accused are acquitted under section 345-(6) Cr.P.C in consequence of compounding the Qisas by the adult legal heir i.e father of the deceased lady Mst: Mumtaz Khatoon but nothing has been brought on record by the parties in respect of compounding the offence or compensation of the above mentioned minors legal heirs of the deceased Mumtaz Khatoon. Resultantly, in spite of acquittal under section 345-(6) Cr.P.C both the accused persons namely Imdad Ali and Subhanallah alias Abdul Subhan, both by caste Shaikh, are required to pay Diyat amount to the above mentioned minors legal heirs of deceased lady Mst: Mumtaz Khatoon. The Diyat amount shall be paid by both the accused persons with reference to current financial year. In order to execute instant order accused Imdad Ali and Subhanallah alias Abdul Subhan, both by caste Shaikh who are produced in custody are remanded to the same jail authority for want of payment of Diyat amount to the above mentioned minors legal heirs of the deceased lady, however, they shall be released on bail subject to furnishing security equal to Diyat amount imposed on them by this court to the satisfaction of this court. In case of non payment of above mentioned Diyat amount by both the above named accused persons, to the minors legal heirs of the deceased lady, both the accused persons shall remained behind the bars until they make the payment of above mentioned Diyat amount good to the minors legal heirs of the deceased lady and the same amount shall be recovered from both the accused persons, as arrears of land revenue. | For Hearing of Compromise Appl: | 0 | 0 | ADJ I, Kandhkot |
