Since, at the present stage, the complaint is registered owner of the subject land and he alleged his dispossession from the same by the accused persons forcibly and the SHO has also confirmed the incident duly recorded in FIR NO.126/2026, hence, elements of an offence under Section 3 of the Illegal Dispossession Act, 2005, are floating on the surface of the contents of complainant & investigation report.
