Case called. Learned ADPP for the State is present. Accused Wahid Muhammad is present on bail. Learned DC is also present. The IO has submitted the charge-sheet. Case is registered against the accused accordingly. Learned DC has filed an application for release of personal search articles. Report has been submitted by the IO, and personal search of the accused has been released as per memo/fard, accordingly. In compliance with Section 241-A Cr.P.C., copies of all relevant prosecution documents were supplied to the accused, which were duly acknowledged vide receipt placed on record as Exh.01. The accused moved an application seeking waiver of the mandatory waiting period, which was taken on record as Exh.02. Thereafter, charge was formally framed against the accused and recorded as Exh.03. Upon framing of charge, plea of the accused was recorded at Exh.3/A, wherein the accused pleaded guilty and prayed for mercy of the Court. Additionally, the accused submitted a written application admitting guilt, which has been placed on record as Exh.04. Subsequently, show-cause notices regarding sentencing were issued to the accused, marked as Exh.05, to which he submitted his reply, placed on record as Exh.06. After hearing learned ADPP, learned DC, and considering the voluntary plea of guilt and replies submitted by the accused, the matter was taken up for order. Resultantly, the accused is hereby convicted U/sec. 243 Cr.P.C. on the basis of his voluntary plea of guilt. He is sentenced to undergo imprisonment till rising of the Court and to pay a fine of Rs. 1,000/-. In default of payment of fine, he shall be taken into custody and sent to Judicial Custody for one week only. The accused has paid the fine amount before the Nazir/Accountant of this District Court. In compliance with Section 371 Cr.P.C., a certified/true copy of this order has been supplied to the accused free of cost under receipt placed on record as Exh.07. The bail bond of the accused stands cancelled. Surety shall be discharged after expiry of the appeal period, accordingly. |
