Perusal of instant application shows that though the learned DDA has prayed for permission to defendants No.13 to15 for filing written statement but in the instant matter only nine defendants are arrayed. On the other hand the civil suit in hand bears No.31/2013 with title of Mst. Ghulam Zainab vs Government of Sindh and others in which all defendants are Government officials but the learned DDA has mentioned title as Mst. Ghulam Zainab vs Jan Muhammad and others though none with the name of Jan Muhammad is party in this suit. In the instant application, the learned DDA has also quoted an order for setting it aside but he has neither mentioned the date or nature of said order nor he has annexed copy of such order with instant application. For the foregoing reasons, the instant application is misconceived so also not in proper form, hence, not maintainable, as such the same is dismissed accordingly with no order as to costs.
