The Judgment and decree dated:02.10.2026 passed by the learned Senior Civil Judge, Kandhkot, in F.C Suit NO.34 of 2026 are hereby set aside. The suit is remanded to the learned trial court for fresh adjudication u/o XLI, rule 23-A, r/w section 107 and 151 CPC, after providing both parties a fair opporunity of hearing and determining the essential found question in accordance with law. The parties are directed to appear before the learned trial Court on 21.10.2026 for further proceedings. The learned trial Court shall endeavour to conclude the proceedings expeditiously, preferably within one month of receipt of the record, subject to the requirement of due process and the applicable law. There shall be no order as to costs of this appeal. Decree sheet prepared accordingly. |
