Suit is called, which is oldest one of 2010 it is pertinent to mention that initially this suit was disposed of U/O 17 R 3 CPC by way of judgment dated: 22-01-2025 later on such judgment was assailed in Civil appeal No. 11/2025 and matter was decided by way of judgment dated: 28-10-2025 with strict direction suit was remanded wherein parties were directed to appear before the court without claiming the Court motion notice R & Ps of the appeal was received by this Court on 08-11-2025 and matter was put off to: 20-11-2025, 16-12-2025, 24-11-2025 so also today but plaintiff has not bother to appear nor any intimation has been received, their counsel is called absent despite of that matter is kept a side and will be taken up at 11-00 a.m, in case of failure matter will be proceeded accordingly. Compared copy of Judgement and Decree 28.10.2025 received in Civil Appeal No. 11/2025 from Honorable 3rd Additional District Judge, Shikarpur, passed in F.C Suit. 31/2010 Regarding Gul Hassan Brohi & Others v/s P.O Sindh & Others to which it has been observed by Honorable court that the impugned Judgement and Decree passed by learned trail court are set aside and case is remanded to learned trail court with directions to decide the suit by giving fair opportunity to both parties to prove their respective claims by producing their respective Evidence and documents within the period of three months. Needless to mentioned here that stage of above matter will be same as it was before passed impugned judgement and decree. the parties and their are present in court and directed to appear before learned trail court on 06.11.2025 without claiming the court mentioned notice. attorney of appellant strictly directed to appear before learned trailed court and lead his evidence without any further delay and in case of deliberate default. Learned trail court would be at liberty to proceed further and decided case as per law. consequently the civil appeal in hand stands allowed. subject to payment of cost. of Rs. 25000/- by appellants to the respondent No.08 who is also attorney of other contesting respondent within 15 days through Nazir of learned trail court.
