Moreover, since the Plaintiff has filed the suit for damages against the private Defendant No.1 alleging that the construction raised by Defendant No.1 is illegal without approval plan and has caused serious damage to the Plaintiff???s property and an application under Order XXXIX rule 1 & 2 CPC is also pending for hearing, therefore, before hearing such application and passing any order thereon, it is appropriate here to appoint the Nazir of this Court for site inspection and submit detail report in this regard. Accordingly, the Nazir of this Court is appointed as Commissioner with direction to inspect the site in presence of Plaintiff, Defendant No.1 and their Advocates alongwith official/technical staff of SBCA and to collect such reports/record showing the actual damaged sustained to the Plaintiff???s property if any and whether the same is result of construction raised by Defendant No.1 on his property or not and further expected damage to the Plaintiff???s property if any due to subject construction raised by the Defendant No.1. The Nazir fees shall be fixed at Rs.10,000/=, which shall be deposited by the Plaintiff within one week time with the Nazir of this Court.
