Matter called: Plaintiff is called absent but his learned counsel is present. The matter was fixed for maintainability of the suit for admission or otherwise, meanwhile, the learned counsel for the plaintiff moved withdrawal statement subject to direction to revenue officials to conduct official partition/demarcation of the suit property bearing revenue survey No. 361, total area 10-39 acres. Order passed on separate sheet. From the perusal of plaint it appears that matter is of demarcation and such application of plaintiff is still pending before revenue forum. Therefore, the suit of plaintiff is hereby dismissed as withdrawn with permission to file afresh subject to law with direction to AC, Shahdadpur to entertain the application as per law and decide the same within 30 days after receipt of this order. The pending miscellaneous application is hereby disposed of accordingly. |
