Criminal Misc: application called: Applicant is absent, his counsel is present. Respondents called absent. Conditional order passed and announced in open court having following directions: - A) Realizing chilies related economic activities and agro-economic potential of this area, Respondent No: 01 i.e. Assistant Commissioner Taluka Kunri is directed as under:- i) Remove all such chillies spread near to the houses of said locality within range of 180-200 feets. Ensure that there should be a minimum distance of 180-200 feet from such spread-chillies on said ground to the houses of said locality. ii) To devise a proper strategy in consultation with other official respondents and concerned stake holder that there should be a reasonable distance from shops, roads near to said spread chillies. iii) Communicate this order to concerned land owners/chillies owners and remove such chilies as directed above and spread a widespread message to general public to confine spread of chillies for drying purpose only to the limited area and maintain distance of minimum 180-200 feets from residential areas. Respondent No:1 is further directed to submit such compliance report along with photographs within 7 days hereof or show cause as to why this order be not made as absolute. All official respondents shall coordinate Official respondent No:1, for lawful needed assistance in implementation of this conditional order in letter and spirit. Needless to mention that non-compliance thereof by any of respondents may lead to penal action as envisaged under the Pakistan Penal Code, 1860 and Code of Criminal Procedure Code, 1898.
