R & Ps of instant Crl.Revision Application u/s 435,439-A Cr.P.C received by this Court from Honourable Sessions Judge, Kashmore @ Kandhkot by way of transfer for its disposal according to law. The matter is already fixed for today, therefore, called. Applicants/petitioner Doulat Meer and Faisal Iqbal are called absent, while their counsel Mr.Ayaz Ahmed Faras is present. Oppoents are also called absent. Mr.Gahi Khan Bangwar, learned ADPP for the State is present. Arguments heard from both the sides. For the reasons to be recorded, the instant Crl.Revision Application is not maintainable and is accordingly dismissed in limine. It is clarified that no opinion is being expressed on the merits of the question whether the offences alleged against the applicants are, in fact, triable by the Anti-Corruption Special Court or whether the ingredients of the relevant Anti-Corruption provisions are made out. The applicants shall be at liberty to avail themselves of any other remedy available to them under the constitution or law before the competent forum. Revision dismissed accordingly. |
