In the light of foregoing discussion in order and findings, and in exercise of the inherent powers of this Court under Section 151 CPC to secure the ends of justice, prevent misuse of the judicial process, and conserve valuable judicial time, it is held that the plaint filed by plaintiffs is patently defective, legally untenable, and barred by law, and is therefore liable to be rejected under Order VII Rule 11 CPC read with Section 151 CPC; consequently, the application filed by defendant No.4 under said provisions stands allowed, with no order as to costs, with the result the plaint of the suit of the plaintiffs is hereby rejected being barred by Section 172 of the Sindh Land Revenue Act, under Order VII Rule 11(d) CPC, and not maintainable before this Court, however, parties shall remain at liberty to approach the competent forum for redressal of their grievance in accordance with law. |
