The amended plaint dated 07.03.2026 filed by Muhammad Zafar Ahmed is accepted only to the limited extent of impleadment of Mst. Sakina Bibi widow of deceased Abdul Razzaq, Shahid, Mst. Shahnaz and Husun Bano as Defendant No.4(a to c) and Defendant No.5, strictly in terms of order dated 12.02.2026 passed by this Court. However, all additions, alterations and incorporations made beyond the scope of the aforesaid order in the title of the suit are hereby struck off being unauthorized and contrary to the directions of this Court. Consequently, the names of alleged siblings namely Abdul Hameed, Mst. Sabira and Mst. Hameeda impleaded as Defendant No.6, 7 and 8 respectively without any permission/order of the Court are hereby struck off from the array of parties/title of the amended plaint. The Plaintiff is further directed to restore and correct the title/nature of the suit strictly in accordance with the original plaint i.e. ???Suit for Declaration, Possession and Permanent Injunction.??? Consequently, the additions relating to administration, partition and mesne profits incorporated in the title of the amended plaint are also hereby struck off being beyond the scope of amendment allowed by this Court. The Plaintiff shall further correct the memo of parties, serial/sequence of Defendants and corresponding references in the body of the plaint strictly in conformity with the order dated 12.02.2026 and original structure of the plaint. Necessary corrections regarding series/sequence of Defendants in the body of plaint shall be carried out with red ink under signatures of counsel for the Plaintiff. However, if the Plaintiff or any party intends to implead any additional person(s) as parties to the suit, he/they shall remain at liberty to file an appropriate application in accordance with law. Likewise, if the Plaintiff seeks to substantially alter or transform the nature and complexion of the present suit into one for administration, partition or any other independent relief, he shall also remain at liberty to withdraw the instant suit and institute a fresh suit of appropriate nature before a Court of competent jurisdiction, in accordance with law. The Plaintiff shall carry out the necessary corrections by replacing/correcting the first two pages of the amended plaint pertaining to the title and nature of the suit, accordingly within fifteen (15) days from today. However, since no substantial alteration has been made in the factual narration or in the substance of the remaining pleadings and prayer clauses, the remaining paragraphs of the amended plaint shall remain intact subject to the aforesaid corrections. Consequently, the written statements/amended written statements already filed by the Defendants and available on record shall remain unaffected and shall continue to form part of the record.
