Case called. Accused Farhan, Jai Ram and Muhammad Zaman are present on bail. Learned ADPP is present. Today the case is fixed for framing of charge. Perusal of the R&Ps sent up by the learned Civil Judge & J.M-I. Hala shows after taking cognizance of offence punishable Section 397 PPC, he sent up the R&Ps of the case for the reason that same is exclusively triable by the Court of Sessions. However, on perusal of police papers it appears that during the commission of offence neither accused used their weapons, nor any person sustained injury which is one of the ingredients to invoke offence punishable under section 397 PPC. Thus the case is triable by the Court of Judicial Magistrate for the offence punishable under section 392 PPC. For the reasons discussed hereinabove the R & Ps of the above mentioned case is hereby transferred to Civil Judge & J.M-I. Hala to proceed with the trial of the case in accordance with the law. Present accused are directed to attend transferee Court on next datte of hearing.
